| dc.description | ABSTRACT: In our country, the protection of personal data is under constitutional guarantee for the first time with the Constitutional amendment made in 2010, with the statement added to the last paragraph of Article 20 of the Constitution that everyone has the right to demand protection of personal data. The procedures and principles regarding the protection of personal data entered into force with the Personal Data Protection Law No.6698, published in the Official Gazette dated 07/04/2016 and numbered 29677. Today, administrations, the provision of public service, social security and economic order, etc. It processes many data about individuals during its provision and the responsibility of the administrations comes to the fore due to the illegal processing of the data. On the other hand, although the administrations are in the position of processing personal data, they are also organized in the field of protection of personal data and provide public service due to the regulations and inspections in the field of personal data protection by the Personal Data Protection Authority established by Law No. 6698 and the Personal Data Protection Board, which is the decision-making body of the Institution. Our study consists of two parts, in the first part, some basic information on the protection of personal data, in the second part, in the light of the relevant legislation provisions, doctrinal examination, judicial decisions and the decision of the Personal Data Protection Board, the obligations of the administrations within the scope of Law No. 6698, the legal and criminal sanctions to be applied and the scope of the Law. | dc.description.abstract | Ülkemizde, kişisel verilerin korunması ilk kez 2010 yılında yapılan Anayasa değişikliği ile Anayasanın 20 nci maddesinin son fıkrasına eklenen, herkesin kendisiyle ilgili kişisel verilerin korunmasını isteme hakkına sahip olduğu şeklindeki ifade ile anayasal güvence altına alınmıştır. Kişisel verilerin korunmasına ilişkin usul ve esaslar ise 07/04/2016 tarihli ve 29677 sayılı Resmi Gazete’de yayımlanan 6698 sayılı Kişisel Verilerin Korunması Kanunu ile yürürlüğe girmiştir. Günümüzde idareler, kamu hizmetinin sunumu, sosyal güvenliğin ve ekonomik düzenin vb. sağlanması sırasında bireyler hakkındaki birçok veriyi işlemekte olup verilerin hukuka aykırı işlenmesi nedeniyle idarelerin sorumluluğu gündeme gelmektedir. Diğer taraftan idareler kişisel verileri işleyen konumunda ise de 6698 sayılı Kanun ile kurulan Kişisel Verileri Koruma Kurumu ve Kurumun karar organı olan Kişisel Verileri Koruma Kurulu tarafından kişisel verilerin korunması alanında düzenlemeler ve denetlemeler yapılması nedeniyle aynı zamanda kişisel verilerin korunması alanında örgütlenmiş olup kamu hizmeti sunmaktadır. Çalışmamız iki bölümden oluşmakta olup birinci bölümünde kişisel verilerin korunmasına ilişkin bazı temel bilgiler, ikinci bölümde ise, ilgili mevzuat hükümleri, doktrinel inceleme, yargı kararları ve Kişisel Verileri Koruma Kurulu kararı ışığında 6698 sayılı Kanun kapsamında idarelerin yükümlülükleri, uygulanacak hukuki ve cezai yaptırımlar ve Kanun kapsamı dışında hükümler hakkında bilgi verilmesi amaçlanmıştır. | |
