| dc.description | ABSTRACT: In this study, the institution of ombudsman is examined. The institution of ombudsman means supervising of government’s acts and operations. The institution provides citizens convenience application to the government. Furthermore, it ensures the citizens quicker and fairer decisions. The institution has common practice in most of the world. In the first part of the study, definition and emergence of the institution is explained. Then, historical development of the institution is clarified. The institution’s classical constitution, jurisdiction pale, assigned position and its responsibilities are considered. Lastly, the varied practices in the world are studied. The second and third part of study namely, “The Institution of Ombudsman in Turkey”, the institutions that function like the institution of ombudsman are studied. The legislative studies about the ombudsman are explained before the institution come into power. Then the last legislative law in Turkey is explained. The Turkish academics have focused on the studies were prepared before the institution of ombudsman come into power. This project has prepared after the institution come into active in Turkey. Thus, this study different from the former studies has the opportunity of examining the present situation of the institution of ombudsman. | |
| dc.description.abstract | Bu çalışmada idarenin eylem ve işlemlerinin denetlenme şekillerinden biri olan ombudsmanlık kurumu incelenmiştir. Vatandaşlara sağladığı başvuru kolaylıkları ve hızlı, adil karar alabilmesi yönleriyle diğer denetim türlerinden ayrılan kurum; oldukça uzun bir süredir dünya genelinde uygulanmaktadır. İlk bölümde kavram incelemesi ve doktrinde getirilen farklı tanımların değerlendirilmesi yapılarak kurumun ortaya çıkışı ile tarihsel gelişimi açıklanmıştır. Daha sonra klasik ombudsman kurumunun yapısı, görev alanı, yetkileri, sorumlulukları ile taşıdığı özellikler değerlendirilmiştir. İlk bölümün son kısmında kurumun dünya ülkelerindeki farklı uygulamaları irdelenmiştir. İkinci ve üçüncü bölümlerde ise sırasıyla ülkemizdeki ombudsman benzeri denetim mekanizmalarından, Kurum faaliyete geçmeden evvel gerçekleştirilen akademik çalışmalar ile hazırlanan fakat mevzuat olarak yürürlüğe girmeyen çalışmalardan bahsedilmiştir. Türkiye’de ombudsmanlık kurumunu oluşturan ve halen yürürlükte bulunan 6328 Sayılı Kamu Denetçiliği Kurumu Kanunu incelenmiş akabinde Kurumun farklı açılardan değerlendirilmesi yapılarak Kurum çalışmalarına yer verilmiştir. Kurum faaliyete geçmeden önce yapılan çalışmalar daha çok kurumun Türkiye’de taşıması gereken özelliklere ve eleştirilere yoğunlaşmıştır. Çalışmamız Kurumun işlerlik kazanmasından sonra hazırlanmış olması yönüyle -diğerlerinden farklı olarak- mevcut bir yapıyı inceleme ve değerlendirme fırsatını yakalamış bulunmaktadır. | |
