Abstract
Description
Presidential Decree and Its Position in the
Hierarchy of Norms
ABSTRACT: The term “Presidential decree” appeared for the first time in Turkish law with Article 107 of the 1982 Constitution in order to regulate the “Secretariat General of the Presidency" by the President, and the content of the first Presidential decree enacted in 1983 in Turkey was within the regulatory scope of the Secretariat General of the Presidency. Within the scope of the constitutional amendments that took place in 2017 and enabled the transition to the Presidential government system, Article 107 of the 1982 Constitution that determined the Presidential decree to be issued in order to regulate the Secretariat General of the Presidency has been abolished and the Presidential decree has become a legal norm that can be issued in matters of executive power by the President, who is the sole wing of the executive body. The regulatory area and position of the Presidential decree in the hierarchy of norms, which expresses the superior - subordinate relationship between the legal norms, has become controversial in the doctrine. Hereby, this study was conducted in an attempt to analyze the place of the Presidential decree in Turkish legal system and its position in the hierarchy of norms in comparison to other legal norms, on the basis of the regulatory power of the executive body.
