Abstract
Bilgi edinme hakkı, günümüzde demokrasinin ve hukukun üstünlüğünün
gereklerinden sayılmakta ve bu hakkın yönetimde demokrasinin sağlanmasında
önemli bir işlev gördüğü kabul edilmektedir.
Türkiye’de, Avrupa Birliği uyum projeleri kapsamında yapılan
düzenlemelerden biri de hem kamu kurum ve kuruluşlarının sahip olduğu bilgiyi
daha verimli ve etkin bir biçimde yönetmelerini sağlayacak hem de vatandaşların
kamu hizmetleri konusunda bilgi edinme hakkını yerine getirecek olan “Bilgi
Edinme Hakkı Kanunu” dur. Sözü konusu kanun, şu anda yetmişin üzerindeki ülkede
yürürlüktedir ve demokratik ve şeffaf yönetimin gereği olan eşitlik, tarafsızlık ve
açıklık ilkelerine uygun olarak kişilerin bilgi edinme hakkını kullanmalarına ilişkin
esas ve usulleri düzenlemek için hazırlanmıştır. Böylece kurum ve kuruluşların
üretmiş oldukları kurumsal bilgi kontrol altına alınacak, güvenlik, gizlilik ve
paylaşılabilirlik sınırları belirlenecektir. Bu çalışmada bilgi edinme hakkının
kavramsal çerçevesi ve tarihsel gelişimi incelenmiş, genel olarak bilgi edinme
hakkının Türk Hukuku ve Karşılaştırmalı Hukuktaki görünümü irdelenmiştir.

ABSTRACT: The right to information, today considered one of the requirements of democracy and the rule of law, and where this right is considered an important function in ensuring democratic governance In Turkey, one of the arrangements made under the European Union harmonization projects with both public agencies and institutions that will manage information more efficiently and effectively as well as citizens' right to information about public services to fulfill the "Right to Information Act" stop. Lyrics of the law in force at the moment more than fifty countries and the democratic and transparent governance as a requirement on the equality, in accordance with the principles of impartiality and openness principles and procedures concerning the exercise of their right to information has been prepared to organize. Thus, the institutional knowledge that are produced by institutions and organizations can be under control, security, privacy and shared bilirlik determined limits. And the historical development of the conceptual framework of this study examined the right to information, right to information in general appearance of the Turkish Law and Comparative Jurisprudence are discussed.
