Abstract
Mülkiyet hakkı, temel hak ve ödevlerden biri olup, 1982 Anayasası ve
Avrupa İnsan Hakları Sözleşmesi uyarınca korunmaktadır. Mülkiyet hakkı, ancak
kamu yararı amacıyla ve kanunla kısıtlanabilir. Planlı ve kamu ihtiyaçlarına cevap
verebilecek bir kentleşmenin sağlanabilmesi amacıyla hazırlanan imar planları ile
mülkiyet hakkından doğan yetkilerin belirsiz süreliğine kısıtlanması söz konusu
olabilmektedir.
Kamulaştırma yapılmaksızın imar planlarında kamusal alanda kalan özel
mülkiyete konu taşınmaz üzerinde meydana gelen kısıtlılık hali hukuki el atma
olarak ifade edilmektedir. Kamulaştırmasız el atma, uzun yıllar sadece fiili el atma
olarak kabul edilmişse de yargı kararlarıyla hukuki el atmanın da bir tür
kamulaştırmasız el atma olduğuna karar verilmiştir.
Hukuki el atma kavramının Türk Hukukunda kabul edilmesi nedeniyle
kamulaştırma ve kamulaştırmasız el atma kavramlarına değindikten sonra hukuki el
atmanın tanımı yapılmış, niteliği, koşulları ve geçirdiği süreç yargı kararları ışığında
ele alınmış, taşınmaz malikinin hukuki el atmaya karşı başvurabileceği yollar ve
açabileceği dava türleri incelenmiştir.

Confiscation
ABSTRACT: The right to property that is one of the fundamental rights and duties is protected under the Constitution of 1982 and the European Convention on Human Rights. The right to property can only be restricted by law and for public benefit. The municipal development plans prepared to provide an urbanization that is planned and also can meet public needs and the authority arising from the right to property can be restricted for indefinite periods. Municipal development plans without expropriation, the state of restriction occurring on the immovable subject to private property in the public sphere is expressed as legal confiscation. Although confiscation without expropration has been accepted as only actual confiscation for many years, it has been decided that legal confiscation with adjudication as a type of confiscation without expropration. With the reason of the concept of legal confiscation is accepted in Turkish Law, the definition of legal confiscation is made after addressing the concepts of expropriation and confiscation without expropration and its qualification, conditions and the process it has gone through are evaluated in the light of adjudications, and the ways and the types of lawsuits that the immovable property can apply against legal confiscation are examined.
