Abstract
Bu çalışmada, ülkelerin ekonomik performanslarındaki farklılıkların
kurumsal faktörlerden kaynaklandığı görüşü takip edilerek, yargı sisteminin
etkinliğinin ekonomik büyüme üzerindeki etkisi incelenmiştir. Literatürde, yargı
sisteminin performans etkinliği ve ekonomik büyüme ile ilişkisi konusunda yapılan
çalışmalar hem kuramsal hem de ampirik bakımdan eksiktir. Çalışmanın temel
amacı, literatürdeki boşlukları dikkate alarak, yargının performans etkinliğinin
ekonomik büyüme üzerindeki etkisini araştırmaktır.
Yargı sisteminin sadece maddi hukukun uygulanması yönüne vurgu yapan
çalışmaların aksine, bu çalışmada, yargı sisteminin etkinliğinin karar ve performans
unsurlarından oluştuğu ifade edilmiştir. Dolayısıyla, yargı sisteminin etkinliğinin
karar ve performans ayrımı dikkate alınarak analiz edilmesinin önemi
vurgulanmıştır. Ancak, bu çalışmanın ampirik bölümleri yargının performans
etkinliği ile sınırlıdır. Yargı sisteminin performans etkinliği, Türkiye için 1980-2010
dönemi yıllık verileri kullanılarak, yeni bir endeks oluşturulmak suretiyle
ölçülmüştür. Ayrıca, performans etkinliğinin ekonomik büyüme ile ilişkisini ortaya
koyan ampirik bir model oluşturulmuş ve zaman serisi teknikleri kullanılarak
sınanmıştır.
Tasviri bulgulara göre, 1980-2010 dönemi boyunca yargı sisteminin
performans etkinliğinin istikrarlı olmadığı görülmektedir. Başka bir deyişle, endeks
Türkiye’de belirli dönemlerde yaşanan ekonomik ve politik gelişmelere hassasiyet
göstermiştir. Ampirik model, yargı sisteminin performans etkinliğinin üretim
fonksiyonu yaklaşımına dâhil edilmesiyle oluşturulmuştur. Ampirik sonuçlara göre,
Türkiye’de yargı sisteminin performans etkinliğinin ekonomik büyüme üzerinde
pozitif etkisi olduğu bulgusuna ulaşılmıştır. Bu etkinin, özellikle nüfus başına düşen
hâkim ve savcı sayısı ile davaların temizlenme oranı kanallarıyla ortaya çıktığı tespit
edilmiştir.

The Efficiency of Judicial System and Economic
Growth: The Turkish Case, 1980-2010
ÖZ: In this thesis, the impact of the efficiency of judicial system on economic growth is investigated by considering the view that differences between countries' economic performance result from the institutional factors. There are both theoretical and empirical gaps in the literature, particularly, in those studies which mainly focus on the efficiency of judicial performance and its effects on economic growth. The main aim of this study is to investigate the role of the performance efficiency of judiciary on economic growth by considering the gaps in the literature. Contrary to the studies that focus on the substantive law enforcement of the judicial system, it is argued that the efficiency of judicial system consists of judgment and performance factors. Therefore, the importance of analyzing the efficiency of judicial system in accordance with the judgment and performance classification is emphasized. However, empirical parts of this thesis are limited to the performance efficiency of judicial system. The performance efficiency of judicial system in Turkey is measured, with annual data for the period of 1980-2010, by creating new index. In addition to this, by developing new empirical model, the relationship between performance efficiency of judicial system and economic growth is analyzed with times series techniques. Descriptive findings show that, performance efficiency of judicial system is not stable during the period of 1980-2010. In other words, the index has shown sensitivity to some political and economic developments in Turkey. Empirical model is developed by augmenting the production function approach by including the performance efficiency of judicial system. It is finding that the performance efficiency of judicial system has a positive effect on economic growth in Turkey. This effect especially worked through the channels represented by the number of judges and prosecutors per capita and the clearance rate of cases.
