Abstract
Avrupa Birliği’ne uyum sürecinde Birliğin öne sürdüğü standartlara
ulaşabilmek için Türkiye her alanda iyileştirmelere gitmektedir. Bu
konulardan bir tanesi de sosyal politika içerisinde yer alan İşçi Sağlığı ve İş
Güvenliğidir. Tezimizin amacı Avrupa Birliği’ni, Türkiye- AB İlişkilerini ele
alarak, Türkiye’nin bu süreç içerisinde yapmış olduğu çalışmalara genel
olarak değinmektir.
Avrupa Birliği sosyal politika alanında yaptığı çalışmalarda artık
uzmanlaşmıştır ve üye ülkelerinde de bu alanda oluşturulan standartların aynı
düzeyde olmasını istemektedir. Türkiye ise bu konuda üye ülkelerin
gerisindedir hatta bağımsız İş Sağlığı ve Güvenliği kanunu ancak 2012 yılının
üçüncü çeyreğinde yürürlüğe girebilmiştir.
Bu çalışmada Avrupa Birliği, Türkiye ve AB ilişkileri ve bu süreç
içerisinde İşçi Sağlığı ve İş Güvenliği konusunun gelişimi tarihsel olarak ele
alınmıştır. Son bölümde de Yeni İş Sağlığı ve Güvenliği kanununa kısaca yer
verilerek kanun içerisinde bulunan işgören ve işverenlerin İş Sağlığı ve
Güvenliği konusundaki yükümlülükleri belirtilmiştir.

Occupational Health and Safety in
Turkey within The European Union Accession Process, The Obligations of
Employee and Employer
ABSTRACT: In The European Union Accession Process, Turkey makes the necessary amendments in every field to reach the standards set forth by the Union. One such issue is Occupational Health and Safety within the context of Social Policy. The aim of our study is, in general, to review the European Union, the relations of EU-Turkey, Turkey’s march in the accession process, and is to focus on Occupational Health and Safety Issue, in particular. European Union is well specialized in the field of social policies and wants every member country to reach the same social policy standards. Turkey has been outdated by member countries of European Union regarding this issue; moreover, separate Occupational Health and Safety Law could barely become effective in the third quarter of 2012. In this study, European Union, Turkey-EU Relations, the development of Occupational Health and Safety subject in this process have been worked through from an historical perspective. And in the last chapter, we have mentioned shortly the new Occupational Health and Safety Law. In addition, the obligations of employee and employers in Occupational Health and Safety Law have been underlined.
